By accessing or using the Website, you agree to these Terms. If you do not agree, do not use the Website.
These Terms apply only to use of the Website. Tutoring, academic support, test preparation, counseling, accredited courses, institutional services, and other paid or separately arranged services may be governed by an enrollment agreement, service agreement, school agreement, payment terms, cancellation policy, or other written terms. If there is a conflict, the terms of the applicable written agreement control with respect to those services.

Sinica Education Inc. (“Sinica,” “we,” “us,” or “our”) provides information about educational services, including tutoring, academic support, test preparation, courses, and related educational resources. Information on the Website is provided for general informational and promotional purposes and does not, by itself, create a student, client, advisory, fiduciary, or contractual relationship.

2. Eligibility and Minors

You must be at least 13 years old to use the Website independently. If you are under 13, a parent or legal guardian must access and use the Website, submit inquiries, or provide personal information on your behalf.
If you are under the age of majority where you live, you may use the Website only with the involvement and permission of a parent or legal guardian. A parent or legal guardian who permits a minor to use the Website is responsible for the minor’s use of the Website and compliance with these Terms.

When you submit an inquiry, document, testimonial, feedback, or other material through the Website, you represent that the information is accurate to the best of your knowledge, that you have the right to provide it, and that doing so does not violate another person’s rights or applicable law.

Some jurisdictions do not allow certain warranty disclaimers, so portions of this section may not apply to you. Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SINICA AND ITS OFFICERS, DIRECTORS, EMPLOYEES, INSTRUCTORS, CONTRACTORS, AFFILIATES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, REVENUE, BUSINESS, OPPORTUNITY, OR GOODWILL, ARISING OUT OF OR RELATED TO THE WEBSITE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SINICA’S TOTAL LIABILITY FOR CLAIMS ARISING OUT OF OR RELATING TO THE WEBSITE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID SINICA, IF ANY, SPECIFICALLY FOR ACCESS TO THE WEBSITE DURING THE SIX MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS.
These limitations do not apply to liability that cannot be limited or excluded under applicable law. The limitations in this section concern use of the Website and do not replace any different limitations contained in a separate signed service agreement.

This section does not require indemnification for Sinica’s own unlawful conduct and does not apply where prohibited by law.

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Subject to applicable consumer-protection laws, any dispute arising solely from the Website or these Terms must be brought in the state or federal courts located in Los Angeles County, California, and the parties consent to the jurisdiction of those courts.
This section does not deprive a consumer of protections or remedies that cannot be waived under the law of the consumer’s residence.
